Monday (Jan 22, 2024), SCOTUS, in a 5-4 ruling, ruled that the Biden administration can remove razor wire - installed by Texas - from various points on the Texas - Mexico border.
Gov. Abbot responded and stated that, “the federal government has broken the compact between the United States and the States,” going as far as to release the statement on X/ Twitter.
“That authority is the supreme law of the land and supersedes any federal statutes to the contrary. The Texas National Guard, the Texas Department of Public Safety, and other Texas personnel are acting on that authority, as well as state law, to secure the Texas border.”
- Texas Governor Abbot
Gov. Abbot continued, stating that the Biden administration's failure to "protect each [State] against invasion," as stated in Article IV, Section 4 of the Constitution, "has triggered Article I, § 10, Clause 3." That clause allows the state of Texas to the right of self-defense.
Elon Musk chimed in, stating: “Texas is absolutely right. This administration is deliberately breaking the law by aiding and abetting illegal immigration at an unprecedented scale!”
Vivek Ramaswamy even made a statement:” The claim that Texas is defying the U.S. Supreme Court is flat-out *false.* The Court held that feds can remove the razor wire that TX is installing on the border, but that does NOT stop TX from still continuing to install the razor wire.”
Numerous state governors have offered support to Texas. This is lining up to be an epic fight, a fight that could demolish Biden's chances of re-lection. Biden is in a quandary: either allow Gov. Abbot to win the fight, for the sake of state sovereignty and border security, or very publicly interfere in the matter for the sake of open borders.
It's worth noting very few Americans’ support open borders. Very few.
Meanwhile, these Democrats feel differently.
”Though the Supreme Court this week allowed federal officials — namely, the Border Patrol — to remove razor wire installed by Texas, that order did not affect other flashpoints in the uneasy relationship between feds and state agents. Earlier this month, Texas officials took over a public park on the shores of the Rio Grande in Eagle Pass, using Texas National Guard troops to block the Border Patrol from accessing the park.” - Rafael Bernal, The Hill
“Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border. If Abbott is defying yesterday’s Supreme Court ruling, @POTUS needs to establish sole federal control of the Texas National Guard now.” - Rep. Joaquin Castro (D-TX)
“I agree with Congressman Castro: if Abbott is defying yesterday’s Supreme Court ruling, President Biden needs to establish sole federal control of the Texas National Guard.”
- Rep. Greg Casar (D-TX)
